Regulations on Enrollment and Management of Short-term Tutoring Classes for Foreign Students


Article 1

These regulations are established in accordance with Article 23 of the Tutoring and Continuing Education Act (hereinafter referred to as the Act).

Article 2

Short-term tutoring classes as referred to in these regulations are those approved by the local educational administrative authority (hereinafter referred to as the local authority) and holding a registration certificate.

Article 3

Short-term tutoring classes may enroll foreign students. The procedures and required items, unless otherwise specified in these regulations, shall be handled according to the local authority's regulations on the establishment and management of short-term tutoring classes under the Act.

Article 4

Short-term tutoring classes engaged in teaching Mandarin to foreigners may apply to enroll foreign students from abroad to study Mandarin in Taiwan (hereinafter referred to as overseas enrollment) if they meet the following conditions:

  • 1. Approved and registered by the local authority.
  • 2. Have more than five years of experience in teaching Mandarin to foreigners.
  • 3. Have the capability to develop and compile Mandarin teaching materials.
  • 4. Have no criminal record for foreign students in the country within the last three years.
  • 5. Have not provided false or illegal admissions, attendance, or enrollment certificates to foreign students within the last three years.
  • 6. Have not violated these regulations or the local authority's regulations on the establishment and management of short-term tutoring classes within the last two years.

The countries eligible for overseas enrollment are limited to those with visa-exempt or visa-on-arrival arrangements for entering Taiwan.

Article 5

Short-term tutoring classes, according to the previous article, shall fill out an application form and submit the following documents to the local authority by April 1 of each year for approval by the Ministry of Education (hereinafter referred to as the Ministry):

  • 1. A copy of the registration certificate.
  • 2. A service contract, which must specify the following:
    • (a) Admission, withdrawal, and leave of absence regulations; the leave of absence hours shall not exceed one-fourth of the total course hours.
    • (b) Format of admission approval, including validity period, course start and end dates, reporting deadlines, teaching locations, name of the responsible person, contact email, and phone number.
    • (c) Course content.
    • (d) Minimum teaching hours, with at least fifteen hours per week.
    • (e) Basis for fees and refunds.
    • (f) A guidebook for foreign students.
  • 3. A list of Mandarin teaching personnel, including their educational background, experience, and contact information.
  • 4. A catalog of self-developed Mandarin teaching materials.

Article 6

The Ministry shall invite the Ministry of the Interior, the Ministry of Foreign Affairs, the Council of Labor Affairs (hereinafter referred to as the Labor Council), local authorities, and experts in Mandarin teaching to jointly review the applications mentioned in the previous article.

The review results shall be announced by June 1 of each year. The Ministry may also consider regional balance and quality control factors to limit the total number of short-term tutoring classes approved for overseas enrollment.

The approval period mentioned above is one year, and applications may be submitted again two months prior to the expiration of the approval.

Article 7

If a short-term tutoring class is found to have students engaging in violations or illegal activities, it shall immediately report to the local authority, the Ministry, the Ministry of Foreign Affairs, the Ministry of the Interior, and the Labor Council.

If a short-term tutoring class has significant violations of these regulations or the local authority's regulations on the establishment and management of short-term tutoring classes during the approved overseas enrollment period, the Ministry may revoke or annul the original approval.

Article 8

Foreign nationals with legal residency or stay status studying at short-term tutoring classes shall provide a copy of their foreign passport and relevant residency or stay permit documents when registering for classes.

Foreigners applying from abroad to study Mandarin at an approved short-term tutoring class must provide the following documents:

  • 1. A copy of their foreign passport.
  • 2. A study plan.
  • 3. Proof of sufficient financial resources for the duration of their studies in Taiwan (for a three-month course, at least NTD 150,000).

Foreigners under the age of eighteen or those who have had legal issues while studying Mandarin in the country may not apply from abroad to study at short-term tutoring classes.

Article 9

Foreign nationals with legal residency or stay status studying at short-term tutoring classes may not exceed their stay period.

Foreigners applying from abroad to study Mandarin at short-term tutoring classes may not exceed their stay period, and their total study period may not exceed one year and six months.

Article 10

Short-term tutoring classes shall regularly report to the local authority records of foreign students enrolled in their courses, including their foreign name, gender, date of birth, passport number, nationality, date of entry, stay permit duration, course location, course start and end dates, and attendance records. This information shall be reported on schedule and copied to the immigration authority. Any changes in foreign students’ enrollment after registration must also be reported.

Short-term tutoring classes approved for overseas enrollment shall regularly fill out and update the foreign student roster on an internal online platform designated by the Ministry, including their foreign name, gender, date of birth, passport number, nationality, date of entry, stay permit duration, course location, course start and end dates, and attendance records.

Article 11

These regulations shall take effect from the date of publication.
